Interpretation

The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

For the purposes of these Terms and Conditions:

Affiliate means an entity that controls, is controlled by or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.

Country refers to: Singapore

Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to Gemobsessed Pte. Ltd., 68 Circular Road, #02-01, Singapore 049422. 

Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.

Feedback means feedback, innovations or suggestions sent by You regarding the attributes, performance or features of our Service.

Goods refer to the items offered for sale on the Service.

Orders mean a request by You to purchase Goods from Us.

Promotions refer to contests, sweepstakes or other promotions offered through the Service.

Service refers to the Website, as well as communication or orders placed using these or other methods: WhatsApp, Instagram, in-person.

Terms and Conditions (also referred as "Terms") mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Service.

Website refers to Gemobsessed, accessible from https://www.gemobsessed.sg

You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Acknowledgment

These are the Terms and Conditions governing the use of this Service (including Your purchase of Goods from Us) and the agreement that operates between You and the Company. These Terms and Conditions set out the rights and obligations of all users regarding the use of the Service.

Your access to and use of the Service (including Your purchase of Goods from Us) is conditioned on Your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users and others who access or use the Service.

By accessing or using the Service (including Your purchase of Goods from Us) You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms and Conditions then You may not access the Service.

You represent that you are over the age of 18. The Company does not permit those under 18 to use the Service.

Your access to and use of the Service (including Your purchase of Goods from Us) is also conditioned on Your acceptance of and compliance with the Privacy Policy of the Company. Our Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your personal information when You use the Application or the Website and tells You about Your privacy rights and how the law protects You. Please read Our Privacy Policy carefully before using Our Service.

Placing Orders for Goods 

By placing an Order for Goods through the Service, You warrant that You are legally capable of entering into binding contracts.

Digital Representation of Products

We strive to ensure that the photos and videos of our products displayed on our website and other digital platforms are as accurate and true-to-life as possible. However, due to differences in device screens, display technologies, and individual device settings, we cannot guarantee that the colors, textures, and details you see on your screen will exactly match the physical product. By purchasing our products, you acknowledge and accept that there may be slight variations in appearance when viewed on different devices, and these variations do not constitute grounds for returns, exchanges, or refunds.

Manufacturing Timeframes and Expedited Requests

We pride ourselves on delivering high-quality, handcrafted products, and this requires time and meticulous attention to detail. As such, we may not be able to rush the manufacturing process to meet Your preferred delivery dates without compromising on quality. However, we will make every effort to accommodate individual requests for expedited production where possible. By placing an order, you acknowledge and accept that while we strive to meet your timeline requests, we cannot guarantee expedited delivery, especially if expediting your order will compromise on our quality standards.

Shipping and Delivery

Local Singapore Pickup

If you are in Singapore, we offer local in-person pickups. We encourage you to meet us in person to unbox and inspect your jewellery. We do not recommend using local courier services for delivery in Singapore due to the high value of the products.

Shipping Method

We offer insured FedEx shipping to most countries. Customs charges may be applicable according to the laws of the recipient’s country; such customs charges are to be paid by the recipient. We are not able to pay or bill you for your customs charges.

Shipping Delivery Estimates

We will provide you with an estimated delivery date based on information from our shipping provider. Please note that this is an estimate and not a guaranteed delivery date. We cannot account for delays caused by the shipping provider, or customs processes in Singapore or the destination country.

Delivery Confirmation

A signature is required upon delivery to confirm receipt of your item. Once our shipping provider confirms delivery, the item is considered delivered. 

Responsibility After Delivery

We are not responsible for lost or stolen items once the item’s delivery has been confirmed by our shipping provider. It is your responsibility to ensure the security of the delivered items at your specified delivery address.

International Shipment Insurance

All international shipments are insured for loss or damage during transit. This insurance coverage ensures that you are protected in the unlikely event that your item is lost or damaged before delivery is confirmed.

Your Information

If You wish to place an Order for Goods available on the Service, You may be asked to supply certain information relevant to Your Order including, without limitation, Your name, Your email, Your phone number, Your credit card number, the expiration date of Your credit card, Your billing address, and Your shipping information.

You represent and warrant that: (i) You have the legal right to use any credit or debit card(s) or other payment method(s) in connection with any Order; and that (ii) the information You supply to us is true, correct and complete.

By submitting such information, You grant us the right to provide the information to payment processing third parties for purposes of facilitating the completion of Your Order.

Order Cancellation by Us

We reserve the right to refuse or cancel Your Order at any time for certain reasons including but not limited to:

We reserve the right to refuse or cancel Your Order if fraud or an unauthorized or illegal transaction is suspected.

Refund, Return, Repair and Cancellation Requests from You

All sales and payments, related to bespoke or ready to ship items, are final and non-refundable. We do not accept refund, return or cancellation requests for completed payments and orders. 

As bespoke jewellery orders involve custom manufacturing, a non-refundable deposit is required to confirm bespoke jewellery orders, reserve the purchased gemstones, and start production. We follow the industry standard for such a non-refundable bespoke order deposit, which is 50% of the estimate quoted to the client. The payment of this non-refundable deposit constitutes an agreement by the client to complete the order and to pay the balance amount upon completion of manufacturing and before delivery. The total order amount and non-refundable deposit amount shall be agreed upon between us and the client before commencement of manufacturing via WhatsApp message, Instagram/Facebook direct message, text message or email. In the event that the total payment for the project is not completed, the non-refundable deposit, as well as the gems and/or jewellery that are part of the order, will need to be forfeited by the client.

Gemstones are not available loose - they are sold for setting with us in our jewellery designs. The cost of this bespoke jewellery is separate and additional to the cost of gemstones. The cost of setting our gems into jewellery starts at SGD 1500. 

Our products are meticulously handcrafted. Due to the nature of handmade craftsmanship, each item may exhibit minor variations. These are not defects but rather a testament to the individuality and artisanal quality of each piece. By purchasing our products, you acknowledge and accept that such variations are inherent in handcrafted items and do not constitute grounds for returns, exchanges, or refunds.

All our gemstones are natural, and as such, they may display inherent characteristics and differences including, but not limited to, inclusions, color variability, and slight variations. These natural features are part of what makes each gemstone unique and do not affect the overall quality or value of the piece. By purchasing our products, you acknowledge and accept that such variations are normal for natural gemstones and do not constitute grounds for returns, exchanges, or refunds.

Reporting Defects

If you think that there is a defect in a product after you receive delivery: any defects in the product must be reported within 3 days of delivery. Failure to report within this timeframe will disqualify your eligibility for a repair, replacement, or refund.

Examination and Repair/Replacement

Upon receiving a returned product, we will conduct a thorough examination to assess its condition. If we are satisfied that the product is defective and meets our return criteria, we will, at our discretion: Repair the item according to our company’s quality standards, or Replace the item with an item of the same design and gemstones, provided the item was returned due to a defect.

Refunds for Defective Items

If a defective item cannot be repaired or replaced with an item of the same design and gemstones, we will issue a full refund. The refund will typically be processed back to your original mode of payment as soon as possible after the examination and approval of the return.

Return Shipping Costs for Defective Product Claims

The cost of return transportation for any item you wish to return due to a defect is your responsibility. We recommend using a tracked and insured service to ensure the safe return of the product.

Availability, Errors and Inaccuracies

We are constantly updating Our offerings of Goods on the Service. The Goods available on Our Service may be mispriced, described inaccurately, or unavailable, and We may experience delays in updating information regarding our Goods on the Service and in Our advertising on other websites.

We cannot and do not guarantee the accuracy or completeness of any information, including prices, product images, specifications, availability, and services. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.

Prices Policy

The Company reserves the right to revise its prices at any time prior to accepting an Order.

Validity of Quotes

For bespoke projects, all quotes provided are valid for 14 days from the date of issuance. This limited validity is due to uncontrollable market fluctuations in the prices of gold, gemstones, and diamonds. To lock in the quoted price, you must approve the project and provide the required deposit within this 14-day period.

If the quote is not approved with a deposit within the 14-day timeframe, the quote will expire, and a new quote may be required based on current market conditions.

Payments

You can pay for our Goods through various payment methods, such as, but not limited to, credit cards, Paypal, PayNow and bank transfer. These may be processed by third-party payment processors such as, but not limited to, Shopify, Stripe and Wise.

Payments may be subject to validation checks and authorization by Your payment method’s provider (for example, Your bank or credit card issuer). If we do not receive the required authorization, We will not be liable for any delay or non-delivery of Your Order.

Installment Payment Terms

We offer installment payment plans under the following conditions. By selecting the installment payment option, you agree to adhere to these terms and conditions.

Minimum Payment: The minimum monthly payment amount is SGD 700.

Duration: The maximum duration for the installment plan is 12 months. The full order amount must be paid in full by the end of the 12-month period.

Interest and Fees: Our installment plan is both interest-free and fee-free.

Payment Schedule: Each monthly payment must be completed by the last date of the respective month. If a scheduled monthly payment is not paid by this date, we may give you a one-time grace period of 30 days to complete the payment and resume the installment plan. If this late monthly payment is not completed within this 30 day grace period, it will result in cancellation of the installment plan, as well as forfeiture of the non-refundable deposit, all payments made, and all purchased products. 

Communication and Payment Timelines for Bespoke Projects

Bespoke jewellery projects are a joyful and collaborative process between you and us. To ensure that your project proceeds in a constructive and timely manner, we have included the guidelines below to make it an enjoyable and smooth experience.  

Communication After Deposit

To ensure a timely design process, after your deposit for a bespoke project has been paid, we will share design ideas with you, and we request that you respond to these design ideas within 2 weeks of receiving them. If we don’t hear from you within this period, there is a risk that your deposit may be forfeited.
If you require more time to review the design, please let us know. We truly value your engagement and are here to assist with any questions or feedback you may have.

Communication After CAD Approval

Once a Computer-Aided Design (CAD) has been completed and shared with you, we ask that you provide your feedback or approval within 2 weeks. If you are unable to respond within this timeframe, your deposit may be at risk of forfeiture. We appreciate your prompt attention to keep the project on track.

Payment and Collection of Completed Items

When your bespoke item is ready, we will notify you so that you can arrange for delivery or collection. We kindly ask that the final payment be made within 30 days of receiving this notification, even if you have not yet requested delivery or collected the item.

If we don’t receive payment within this 30-day period, we will send you a gentle reminder. Should we not hear from you within 2 weeks after this reminder, please note that your deposit and any associated gemstones or materials may be forfeited. We sincerely hope to avoid this and are happy to work with you to ensure a smooth and pleasant experience.

Promotions

Any Promotions made available through the Service may be governed by rules that are separate from these Terms.

If You participate in any Promotions, please review the applicable rules as well as our Privacy policy. If the rules for a Promotion conflict with these Terms, the Promotion rules will apply.

Intellectual Property

The Service and its original content (excluding Content provided by You or other users), features and functionality are and will remain the exclusive property of the Company and its licensors.

The Service is protected by copyright, trademark, and other laws of both the Country and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of the Company.

Your Feedback to Us

You assign to the Company all rights, title and interest in any Feedback You provide to Us. If for any reason such assignment is ineffective, You agree to grant the Company a non-exclusive, perpetual, irrevocable, royalty free, worldwide right and license to use, reproduce, disclose, sub-license, distribute, modify and exploit such Feedback without restriction.

Links to Other Websites

Our Service may contain links to third-party web sites or services that are not owned or controlled by the Company.

The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise You to read the terms and conditions and privacy policies of any third-party web sites or services that You visit.

Termination

We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions.

Upon termination, Your right to use the Service will cease immediately.

Limitation of Liability

Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers under any provision of this Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You through the Service.

To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of this Terms), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

As part of Your Order, if You request that We accept your gemstones and/or diamonds for the purpose of setting them for You in a bespoke jewellery, We may consider and accept your request. If We do accept, we cannot be held liable for damage to your gemstones and/or diamonds because they are not from Our inventory and due to the inherent risk in jewellery setting. 

"AS IS" and "AS AVAILABLE" Disclaimer

The Service is provided to You "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Company, on its own behalf and on behalf of its Affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. Without limitation to the foregoing, the Company provides no warranty or undertaking, and makes no representation of any kind that the Service will meet Your requirements, achieve any intended results, be compatible or work with any other software, applications, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.

Without limiting the foregoing, neither the Company nor any of the company's provider makes any representation or warranty of any kind, express or implied: (i) as to the operation or availability of the Service, or the information, content, and materials or products included thereon; (ii) that the Service will be uninterrupted or error-free; (iii) as to the accuracy, reliability, or currency of any information or content provided through the Service.

Governing Law

The laws of the Country shall govern this Terms and Your use of the Service. Your use of the Application may also be subject to other local, state, national, or international laws.

Disputes Resolution

If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Company.

For European Union (EU) Users

If You are a European Union consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident in.

United States Legal Compliance

You represent and warrant that (i) You are not located in a country that is subject to the United States government embargo, or that has been designated by the United States government as a "terrorist supporting" country, and (ii) You are not listed on any United States government list of prohibited or restricted parties.

Severability and Waiver

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Waiver

Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not effect a party's ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.

Translation Interpretation

These Terms and Conditions may have been translated if We have made them available to You on our Service. You agree that the original English text shall prevail in the case of a dispute.

Changes to These Terms and Conditions

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. 

By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the website and the Service.
